Dear Consultee,
FOOD IRRADIATION
In February
1999 the European Council and the European Parliament published
two EC Directives on foods and food ingredients treated with ionising
radiation in the Official Journal of the European Communities. All
Member States are required to implement these Directives by September
2000.
EC Directive
1999/2/EC lays down the general provisions such as the conditions
for treatment, the rules governing the approval and control of irradiation
and changes the rules on the labelling of foodstuffs that have been
treated with ionising radiation. EC Directive 1999/3/EC establishes
an initial positive list of foodstuffs, which could be treated with
ionising radiation and freely traded across the whole European Community.
These Directives
will be implemented in England by a new Statutory Instrument, the
Food Irradiation Provisions (England) Regulation 2000, a
draft version of which is attached at annex A 
.
Comments are invited on this by 19 July 2000. We are also seeking
comments on the draft guidance notes at annex B and want to hear from
business on how it views the likely financial impact of the implementation.
The Agency is particularly keen to receive comments from small businesses
in this respect. A copy of a draft Regulatory
Appraisal is therefore attached for comment at annex C.
In line with
the Agencies policy of openness we intend to make these papers,
and copies of the responses we receive, publicly available at the
end of the consultation period through the library at 3 Whitehall
Place (West Block), London, SW1A 2HH. It will be assumed therefore,
that your response can be made publicly available in this way unless
you clearly indicate that you wish all or part of your response
to be excluded from this arrangement. The library will supply copies

to cover the cost of photocopying and postage, will apply. To enable
requests to be dealt with efficiently, and to avoid undue delay
